These Terms of Service ("Terms") govern your use of the DoublyCheck mobile application (the "App"), provided by Caspari e.U. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. The App
The App is an on-device OCR (Optical Character Recognition) scanner designed to help you compare text strings, such as cryptocurrency addresses or IBANs. Its purpose is to act as a secondary verification tool to help identify potential errors, typos, or malicious alterations (e.g., from clipboard hijacking).
2. IMPORTANT: Disclaimer of Warranties and Limitation of Liability
THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
You acknowledge that the App utilizes machine learning and OCR technology, which is inherently imperfect and can produce errors, inaccuracies, or incomplete results. We do not warrant that the App will be accurate, reliable, secure, or error-free. The App's similarity score (which is capped below 100%) is for informational purposes only and is not a guarantee of a match or a correct scan. While the App is effective at spotting multi-character differences and malicious swaps, it may not reliably detect single-character typos. Its intended use is to provide a general sense of similarity, not to be a definitive source of truth for single-character accuracy.
You must not rely solely on the App for any important action, especially financial transactions. The App is intended as an extra layer of safety, not a substitute for your own diligence and judgment. Always manually and independently verify any address or information before sending funds or conducting a transaction.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CASPARI E.U. BE LIABLE FOR ANY DIRECT OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF FUNDS, CRYPTOCURRENCY, PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of, or inability to access or use, the App;
- Any bugs, viruses, or other harmful code that may be present in the App;
- Any errors, inaccuracies, or omissions in the App's results;
- Any financial loss of any kind, regardless of cause.
This limitation of liability shall apply regardless of the legal theory upon which the claim is based, whether contract, tort (including negligence), strict liability, or otherwise. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above limitations may not apply to you. This does not affect liability that cannot be excluded or limited under applicable Austrian law, such as for damages caused by gross negligence or willful misconduct, or for personal injury.
3. License and Prohibited Conduct
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on devices that you own or control, solely as permitted by these Terms and the usage rules of the app store from which you downloaded it (Apple App Store or Google Play Store).
You agree not to:
- Modify, adapt, translate, reverse engineer, decompile, or disassemble the App;
- Attempt to bypass or circumvent any usage limits or technical protection measures;
- Use the App for any illegal or unauthorized purpose;
- Distribute, rent, lease, sell, or otherwise transfer the App to a third party without our prior written consent. The App may only be obtained from official channels (Apple App Store and Google Play Store).
4. In-App Purchases & Subscriptions
The App may offer optional one-time purchases (e.g., "donations") or recurring subscriptions. All payments are processed by the respective app store provider (Apple or Google). These purchases are subject to the terms and conditions of the app store provider and are non-refundable to the extent permitted by their policies and applicable law.
Because the App does not use user accounts, any purchases made are tied directly to the platform (Apple's App Store or Google's Play Store) on which they were made. Consequently, purchases are not transferable between different operating systems (e.g., a purchase on iOS cannot be used on Android, and vice versa).
5. Intellectual Property
The App and all its original content, features, and functionality are and will remain the exclusive property of Caspari e.U. and its licensors. The App is protected by copyright, trademark, and other laws of both Austria and foreign countries.
6. Changes to the App or Terms
We reserve the right to modify, suspend, or discontinue the App, or any of its features or services, at any time with or without notice. We may also impose usage limits on certain features. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the App. We may also revise these Terms from time to time by posting the updated version on our website.
7. Termination
You can terminate these Terms at any time by uninstalling the App. We may terminate or suspend your license to use the App immediately, without prior notice or liability, if you breach these Terms.
8. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Vienna, Austria, to resolve any legal matter arising from these Terms.
9. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
